Why the Silence on Vertical Restraints?, International In- House Counsel
Abstract
Resale Price Maintenance ( and MAP) programs have been subjected to varying regulatory and legal scrutiny over the years. In the United States, different standards of review have been applied at the federal and state levels to such programs. The author suggests a need for uniformity in the area to give assurances to manufacturers and suppliers who wish to employ these types of pricing programs yet achieve legal compliance.
